Understand how the UAE Federal Tax Authority Reverse Charge Mechanism (RCM) and export documentation protect your cash flow and keep you compliant.
The Regulatory Framework for Mobile Phones in the UAE
Under Federal Decree-Law No. (8) of 2017 on Value Added Tax and subsequent amendments, the UAE Federal Tax Authority (FTA) introduced specialized tax treatment for commercial trading of mobile phones and computer devices to eliminate fraudulent tax chains and improve liquidity for registered B2B operators.
1. The Domestic Reverse Charge Mechanism (Cabinet Decision No. 91 of 2023)
When a UAE-registered mobile phone wholesaler sells to another VAT-registered business inside the UAE mainland for resale or manufacturing, the Reverse Charge Mechanism (RCM) applies:
- The supplier issues a commercial tax invoice indicating that the recipient is liable to account for the tax.
- The buyer accounts for the 5% VAT in their periodic VAT return (Box 3) and simultaneously recovers it as input tax (Box 10), resulting in zero net cash drain.
- Mandatory Document: The buyer must provide a signed declaration confirming VAT registration and intent to resell the devices.
2. International Export: Zero-Rated Treatment (0% VAT)
For international buyers importing mobile phones outside the UAE:
- The supply qualifies for 0% Zero-Rated VAT under Article 45 of Executive Regulations.
- Required Proof of Export: The supplier must retain official Dubai Customs Export Declaration / Bill of Exit, commercial shipping documents (Air Waybill, Bill of Lading, or courier tracking docket), and proof of overseas departure within 90 days.
